PARENT SUES NKHWAZI PRIMARY SCHOOL OVER ALLEGED MISCONDUCT AGAINST GRADE 6 PUPIL
A Lusaka parent has dragged Nkhwazi Primary School to the Lusaka High Court, accusing a member of staff of emotionally and psychologically harming his Grade 6 daughter through alleged inappropriate conduct.
According to a statement of claim filed before the court, the father, identified as DT to protect the identity of the minor, has sued the school on behalf of his daughter, MT, seeking K2 million in exemplary and aggravated damages over the alleged actions of employee Leeroy Phiri.
The lawsuit further seeks damages for vicarious liability, negligence, breach of statutory duty, special damages, interest and legal costs.
Court documents allege that between January 20 and February 10, 2026, Mr. Phiri, a swimming teacher at the school, isolated the pupil from her friends and allegedly demanded a kiss from her while in the school hall.
The father claims the alleged incident left the child suffering from emotional distress, anxiety, trauma and psychological harm.
According to the claim, the school failed in its duty to safeguard the welfare of the pupil and allegedly did not provide proper supervision over members of staff.
The lawsuit also alleges that school authorities failed to immediately inform the parents about the matter and instead instructed the child not to disclose the incident.
DT further contends that despite allegedly being aware of the matter for several weeks, school management failed to suspend or remove Mr. Phiri from the premises and did not arrange counselling for the child.
The claim accuses the school of prioritising its reputation over the welfare and psychological well-being of the pupil.
The matter is now before the Lusaka High Court for determination.
